These Contractual Conditions regulate the use of the website www.Lucianomachadop.com (hereinafter, the Website), owned by:

The use of the Web attributes the condition of User of the same and implies the acceptance of all the Contractual Conditions present in this Web.  
 

  • Lucianomachadop reserves the copyrights of all works sold inside and outside this Website, being free to modify sizes, materials, adjustments, make interventions and to generate any type of art derived from these photographs for private or commercial use.

  • The Limited Editions are linked to the size and material that make them unique, which is why Lucianomachadop will not be able to sell any extra copies with these characteristics once the indicated number has been reached.

  • The User, once the contract is binding and acquires works of art offered on this Website, even if he does not own the copyrights, obtains the ownership of them, being able to sell them if he wishes.

  • Once the contract becomes binding and the User acquires works of art offered on this Website, the User will receive by email a certificate of originality with the exact number of the Limited Edition that he is acquiring. Certificate to be printed, since its commercial value will depend on it. For his part, Lucianomachadop will keep a record of all the works sold.

  • Lucianomachadop will not be responsible for the resulting alterations in the photographs of any of their values, colors and pixels, product of the monitor or screen through which the User browses the Website. For this reason, the images in the photographs are merely indicative.

  • The representation of the products on the Website does not constitute a legally binding offer, but rather a non-binding online catalog.  By clicking the "Buy" button you send a binding order for the product in the shopping cart. Confirmation of the order entry takes place after sending the order and does not yet imply a contractual acceptance. Lucianomachadop can accept your order by sending a confirmation of your order via email and once the funds are available in his account. No contract is carried out on products of one or another order that are not indicated in the shipping documents. In the order, the production costs of the work and art will be informed.  If taxes, customs or interests accrue on a shipment, these expenses would be borne by the User. 

  • Delivery times are without obligation, although they do not usually take more than 15 working days.

  • Lucianomachadop reserves the right to modify the price list for future orders at any time without prior notice.

  • The calculation of the price of the product is made based on the shipping costs, production costs and art, the latter being understood as the capital gain of the artist: Lucianomachadop.

 

Return policy

  • Returns in case of obvious damage to the works of art at the time of delivery will be granted in exchange with a credit to the account or through a promotional code for the same amount within the Website, so that the User can place another order.

  • In case of obvious damage to the works of art at the time of delivery, the User must make a complaint via e-mail to Lucianomachadop within a maximum period of 7 calendar days. For the calculation of the term the time of delivery, as well as the day of the entry of the written notification are decisive.

  • In case of objections, all documents pertaining to the order and a clear photograph where the defect of the product can be observed must be made available to Lucianomachadop. Otherwise, a thorough verification and handling of the defective merchandise claim is not guaranteed.

  • Defects in a part of the delivered merchandise do not give the User the right to complain about the entire delivery.

  • The User will be responsible for the return shipping costs.

  • Depending on the case and the recipient country in which the shipment was made, the User must send the shipment back to Spain or directly to the printing company located in Germany.

  • For its part, Lucianomachadop is obliged to make the reimbursement by means of a credit account or promotional code  within the Website, within a period of no more than 15 calendar days, once the order that the User sent back is received by Lucianomachadop himself or by authorized third parties.

  • The photographs will be sent back at the User's own risk and expense. Reason for which, it is recommended that the User send the works in a correct and protected manner. For this, the most suitable is the original special packaging of the shipment together with all the protective materials.

 

How and with whom is the contract carried out?

The products and services offered on the Web are offered in the name and on behalf of Lucianomachadop.

How is the requested work delivered?

Delivery takes place at the address that the User has indicated on the Website. After sending, you will generally receive a confirmation email.

Conduct in case of unavailability

In the unlikely event that the means of production necessary for your order are not available, you will be informed immediately and Lucianomachadop will give you a delivery date as soon as possible.

How can these general contracting conditions be modified?

Lucianomachadop reserves the right to modify the general contracting conditions at any time and without giving reasons, explicitly informing of the modified conditions on the Web. In case of modification of the general contracting conditions, the user will have to accept them again.
